This may be the start of something big. The judge acknowledges that the operation had significant negative effects to the plaintiff's body. It may set the stage for future lawsuits. I myself have been urged by many friends and family members to seek the advice of a lawyer. I don't know if I'd be able to file a suit against my surgeon because of statute of limitations, though. I'm not sure but I think judges can make exceptions in certain situations depending on the facts of the case. Take for instance the asbestos-mesothelioma cases where these people were exposed and did not exibit symptoms until many years after exposure. They are able to successfully sue for damages. But like the suit states, plaintiff was contraindicated for the surgery because he already had a low resting heartrate and surgery made it even lower. I believe I was contraindicated for surgery because I am asthmatic. Think about it. Deflate someone's lungs when they suffer from an inflammatory lung disease?!? I was wheezing before the surgery and was handed a inhaler to use before the op. I still have it. It has surgeons name on it and date of surgery etc. The surgeon CANNOT DENY he gave it to me. Any thoughts on that?
